The Client

The Australian Digital Health Agency is responsible for national digital health services and systems, with a focus on engagement, innovation and clinical quality and safety. Our focus is on putting data and technology safely to work for patients, consumers and the healthcare professionals who look after them.

The Role

The Senior Legal Counsel role sits within the Legal Services Branch of the Corporate Services Division. The Corporate Services Division is responsible for delivering key enabling services to support the efficient and effective operations to the Agency. Providing a diverse range of corporate services including financial and budgetary services, legal, human resources and work health and safety, information management, policy and privacy, marketing and communications, governance, property and facilities, security, ministerial and parliamentary services.

Reporting to the Director, Legal Services, you will assist the Director, Legal Services in all transactional and administrative matters for the business-as-usual functioning of the legal team for the Agency and provide the required legal services, focusing on commercial and procurement contracting, intellectual property (including ICT) licensing, trade mark protection and a discrete amount of employment law matters for Australian Public Service and common law employees.

You will provide a wide variety of legal advice and services, including in the following key focus areas:

  • commercial and procurement contracting

  • regulatory matters

  • intellectual property/ICT licensing and trademark protection.

  • transactional and administrative matters necessary to the function of the legal team

  • drafting and updating legal templates for use by the Agency

  • legal and corporate policy development

  • maintaining a watching brief on legislative changes impacting the Agency.

A key aspect of the role is that you will act as a business partner to all areas of the Agency and work within the Legal team and the Corporate Services Divisions to support capability growth and the working culture of the team.

Skills and experience

Applicants should be strongly values-driven with a genuine interest in engaging with the team, contribute to the wellbeing of the team and development initiatives. Applicants should also have a strong focus on maintaining and actively contributing to high-quality performance objectives and the collaborative, inclusive and comfortable culture of the legal team.

Applicants must have:

  • At least 8 years' post admission experience and at least 3 years working in-house in generalist commercial contracts, procurement, IP law, privacy law areas (with any employment law experience desirable).

  • Significant and strong legal technical, commercial contracts advising drafting and negotiation skills and experience (solid knowledge of relevant Commonwealth legal frameworks and government procurement requirements highly desirable).

  • Excellent interpersonal skills and strong ability to communicate well with both internal and external stakeholders will be essential.

  • Solutions focused, outgoing, approachable and collaborative.

  • Solid and varied consultative skills with ability to adjust communication style and approach.

  • Previous experience working with government agencies or regulators or practical experience advising on Commonwealth and other employment laws are not essential but highly regarded.

  • Demonstrated effective time management and prioritisation skills.

  • Demonstrated experience building strong relationships with internal and external stakeholders.


Applicants must be Australian citizens to be eligible for employment at the Agency. The preferred applicant will be required to successfully undergo a police record check and be able to obtain and maintain a security clearance at a specified clearance level.

The total remuneration package for this position is $122,716 - $139,959. A job specific allowance may be applicable for this position.
